Pennsylvania Must Bring Laws in Line With the Constitution

According to a paywalled story found here, a man charged for "incest" for having consensual (to be redundant) sex with another adult is challenging the Constitutionality of Pennsylvania's unjust, outrageous, and, yes, unconstitutional laws denying basic human and civil rights. Of course we wish this man well in fighting for civil rights and bringing the laws in line with the Constitution. Pennsylvania should be ashamed of having such terrible laws in place.

I found this related article from msn.com back on what was Independence Day, which is supposed to be a celebration of life, liberty, and happiness. Those are what are being denied to the consanguinamorous.

A brother and sister in their 30’s in Beaver County are being charged with incest after a relationship between the two was revealed.

Who was the victim of this "crime?"

According to the Beaver County Times, the two, half-siblings, both of Freedom, are being charged after police were told of the sexual relationship, which included the two having a child together.

DO NOT TELL THE POLICE!!! IT IS NONE OF THEIR BUSINESS!!!

We know that child is healthy, as most children born to these relationships are.. Otherwise, the article would have mentioned the child's health.

While police were investigating a reported physical assault at the home the two share, the woman told police the two had a child together.

Self-incrimination. DON'T MAKE THAT MISTAKE!

Police were also told that other family members knew of the relationship and the child.

Isn't it normal for family to know these things? Family should be supportive.

The Beaver County Times reports that the woman in the relationship had posted bail, while the man remains in jail on incest charges as well as simple assault and harassment charges.

If he has committed real crimes, try him on those. Sex with another adult shouldn't be crime. Families should not be broken up over it. Children should not lose their parents over it.

Being half-siblings (they share a biological father), this could be a reunion GSA case. Whether it is or not shouldn't matter to the law. Sex should not be a crime. These are consenting adults. The Conway Borough Police Department should only concern itself with crimes in which there are victims.

Pennsylvania and every other US state must drop unjust laws that prevent consenting adults from sharing love, sex, residence, kink, partnership, and marriage how they mutually agree. There is no good reason to arrest, prosecute, and incarcerate people for being consanguinamorous.

I don’t consider cheating to be egregious when it is to get some relief from a spouse or partner who has seriously broken vows or agreements by being abusive, neglectful, etc. Ideally, people would leave relationships in which they are being neglected or rejected, but that isn’t always possible or the best solution for a variety of reasons.

Relationships, especially marriages, can be very complicated. For example, it is easy for outsiders to see a married woman flirting with someone behind her husband’s back, and think less of her for doing so, but what those outsiders don’t see is that her husband barely interacts with her in private and refuses to even touch her and yet he wants her to go without affection and intimacy with others. Not wanting to break up the home of her young children before they are grown, she stays, and seeks comfort with others. Of course this kind of relationship situation happens regardless of genders.

In general, someone who is happy in a healthy relationship and is not deficient in their self-control will not cheat. However, when it comes to Genetic Sexual Attraction, someone who is in a happy relationship or would otherwise never cheat (not with a coworker, not with a neighbor, not with a former partner, not with anyone) may not withstand the dynamics involved, and may cheat as a result. If their relationship was already terminally ill, or experiencing serious problems, then keeping mutual GSA nonsexual is that much less likely.

GSA is usually overwhelming, and bonds formed in its caldera can become especially strong.

When An Older Partner Struggles Emotionally

There's this "ideal" that's perpetrated by what I'd call the relationship police of a man and a woman of the same race, background, and age, or maybe with the man being a couple of years older, marrying, staying monogamous, staying sexually active with each other, raising their two joint children (the only children they ever have) together, then happily growing old together and dying within a few years of each other.

This does happen.

It is not the life story of most people, though. It isn't even necessarily what most people want for themselves.

Some people are gay.
Some people don't want to get married.
Some people don't want children or can't have them.
Some people want more children.
Some people prefer an older lover.
Some people prefer a younger lover.
Some people prefer someone of a different race.
Some people are polyamorous.
Some people have open marriages.
Some people get married more than once.
Some people are asexual.
Some people die well before reaching the average life expectancy.

The variations are almost endless.

Optimistically, the divorce rate for first marriages is as low as 30 percent. Additional marriages have a higher rate of divorce. Some people don't divorce, but their marriage is not a happy, functional one. Those are just the ones who make it to marriage. There are relationships that last for years, and might involve living together, major joint purchases, and children, but they have a breakup rate much higher than first marriages. And then there are the people struggling to even get a relationship going.

I don't write this to be depressing.

I write this to point out that if lovers...

1) are mutually attracted
2) treat each other right
3) don't have major goals in conflict and are otherwise broadly compatible

...they have hit paydirt. Paydirt isn't so easy to find.

Don't Panic If Your Partner Brings Up Swinging

...or any other form of ethical nonmonogamy.
Ever notice that many of the same people who say swinging, or any form of ethical nonmonogamy will destroy a marriage urge someone whose spouse has merely raised the possibility of ethical nonmonogamy to divorce that spouse? Recently I heard two professional commentators who often focus on relationships urge divorce and say something akin to "your marriage is already over" because the spouse brought it up, even though these commentators disagree about many things when it comes to relationships. Then there are the online comments from the masses, which often say the same thing. I was glad to see this answer on Quora from Franklin Veaux, who is an excellent communicator of valuable information regarding ethical nonmonogamy and sex and relationships in general. Let's think things through here.

The Other Shoe Drops in Indiana, Shedding More Light

The other day, we noted and commented on an arrest in Indiana. Here's word of a second arrest in the same case, and more information about the case, from Liz Shepherd at the same news website.

A second individual was charged with incest after admitting to having sexual intercourse multiple times with a male relative. 

Charges have officially been filed against William Glenn Davis, 54, 23095 Tyler Road, Lakeville; and Samantha Lyn Davis, 21,1903 West Point Drive, Warsaw. Each have been charged with incest, a level 5 felony.

They are consenting adults. This shouldn't be a law enforcement matter in the first place.

On Jan. 17, an officer with the Warsaw Police Department responded to a domestic disturbance at a Warsaw residence. The officer arrived and spoke with Samantha Davis and her ex-boyfriend. Both subjects were accusing the other of domestic violence.

So this was NOT about domestic violence between the defendants.

According to the affidavit of probable cause, the officer spoke with the ex-boyfriend, who advised that he and Samantha Davis were arguing because she was having sexual relations with William Davis. Samantha Davis admitted in July 2018, she started having sexual intercourse with William Davis at her residence. She had sexual intercourse and sexual conduct with him multiple times during 2018. The relationship between Samantha Davis and William Davis was removed from court documents.

Based on the laws and their ages, she's either his daughter or his niece; there's a slight chance she's his granddaughter or half-sister. Those are the possibilities.

So they were ratted out by her ex-boyfriend, who may or may not have gotten into a domestic violence situation with her. Too bad he wasn't an ally.

Is Indiana Still Arresting Consenting Adults?

From infreenews.com comes a report of a "President Of Local Business Arrested For Incest"...

William Glen Davis, 54, 23095 Tyler Road, Lakeville, was arrested at 5:46 p.m. Friday, Jan. 18, on a charge of incest. Davis is president of Lake City Heat Treating Corporation, 2427 N. Boeing Road, Warsaw.

Why do they include a picture, name, address, and his business? How is that relevant??? Why not hand the bigots pitchforks???

Notice the charge is "incest" and not "assault."

According to information from authorities at the Warsaw Police Department, police were notified of a domestic complaint Thursday, Jan. 17, on West Point Drive, Warsaw.

These days, neighbors can call in a "domestic complaint" and the police are usually obligated to investigate. No proof other than what the caller says need be offered. On the other hand, it could be that someone inside the home was scared and called the police. We aren't given enough detail.

Detectives went to the scene and during the interview with an adult female involved in the domestic complaint, she told police she had been having sexual relations with a relative. That relative was Davis. 

Police report the relationship had been going on for some time and was confirmed by both parties involved. 

Davis was interviewed by police and arrested following the interview. Charges have been signed and filed with the prosecutor’s office.

A few things to say:

1) She is an adult.

2) Sexual relations and assault are two very different things. He was arrested for "incest" and not assault.

3) Indiana, like most states, doesn't criminalize sex between first cousins, so unless police acted outside the law, that means this relative is either his mother (or grandmother), daughter (or granddaughter), niece, aunt, or sister, because Indiana DOES still criminalize sex between those consenting adults.

4) Perhaps they didn't know that sex between consenting adults is still criminalized in Indiana, and so they had no hesitation to tell the police they have sex? Here's what consanguinamorous people need to do to protect themselves.

More charges are expected pending further investigation.

What does that mean? That the woman, who also broke the unconstitutional law, is going to get arrested and charged? THIS IS A WASTE OF PUBLIC RESOURCES! If he assaulted her or anyone else, charge him with that. If consenting adults are having sex, that shouldn't be crime. Consanguineous sex happens every day not far from where you are reading this, wherever you are. Thankfully, most of it never results in an arrest. Stop this senseless persecution. There is no good reason to deny them their right to be together. We need relationships rights for all, including full marriage equality, everywhere.

I'm glad Jane got to this one before I could. She perfectly explains the injustice and absurdity of prosecuting an adult for having consensual (to be redundant) sex with another adult.

These laws, where they still exist, are doing terrible damage to the lives of people who aren't hurting anyone.

LAURENS COUNTY — A father and daughter are charged with incest in Laurens County after a child was born, police say.

So we charge people with crimes now because of births?

Investigators in Laurens County were looking into an alleged sexual abuse incident when they learned that Katlyn Edwards had given birth to a child after being impregnated by her biological father, James Travis Brown, the Laurens County Sheriff’s Office said in a statement.

Consanguinamory shouldn't be a crime.

“During the investigation, we learned (Edwards and Brown) had been in a consensual relationship when she became pregnant,” the sheriff’s office said.

STOP. Consensual. That should have ended things.

According to the sheriff’s office, both Edwards and Brown claimed their relationship was “consensual and mutual” during investigators’ interviews. 

“Investigators also found other evidence to support their claim that the relationship was consensual,” the sheriff’s office said.

Are we clear that it was CONSENSUAL??? The problem is, people confess all of the time because they don't think consensual sex would be a crime, but it still is in some places. So don't talk! Use your right to remain silent.

I wonder what the evidence is? My guess is either texts or video. Be careful, lovers!

Edwards was arrested on Monday without incident and taken to the Laurens County detention center. She is not currently listed as being jailed.

She shouldn't have been arrested in the first place!

The child died at a medical facility in Charleston, South Carolina, according to the statement. 

How sad.

“It is beyond my comprehension how this could take place between a father and daughter,” Laurens County Sheriff Don Reynolds said.

Really? How long have you been in law enforcement? This happens all of the time, especially in reunion GSA situations. We don't know if this was a reunion situation, but their surnames are different. That could be for any number of reasons.

“At this time, I can’t confirm the baby died from complications related to incest, however we wonder if that’s the case."

Most children born to these relationships are healthy. Most children born with serious health problems in the US don't have those problems are a result of consanguinity.

"We are working with medical professionals and the Solicitors Office regarding that aspect of the investigation and will update everyone if there are any additional charges.”

Since they don't mention murder or signs of abuse, my guess is he's talking about prosecuting them for, essentially, having a genetic problem. Well guess what? If people in consanguinamorous relationships could feel confident in being completely honest with medical professionals, it is less likely that children will suffer with health problems. So we need to stop arresting and discriminating against them and, instead, offer services and study them so we can help people.

People of South Carolina and Laurens County in particular: Stop putting people in jail for sharing love and sex. There is no good reason to continue to persecute consenting adults for loving each other as they mutually agree.

To the persecuted defendants: So sorry what has been done to you, especially after losing a child. If you can, move someone better as soon as you can. There are countries that don't treat adult lovers are criminals, and you will also not be criminalized in New Jersey or Rhode Island.

New Zealand Still Prosecuting Consenting Adults

A couple this blog last covered in 2012 were back in the criminal system and back in the courts in New Zealand.

Let's go back to a report at nzherald.co.nz from September 2016...

A father and daughter pleaded guilty to incest when they appeared in the Dunedin District Court this afternoon.

Judge Kevin Phillips convicted them and remanded them on bail, with conditions prohibiting communication between the pair, for sentence in November.

This is outrageous. They have a consensual relationship, initiated through Genetic Sexual Attraction, and there is no reason to deny them communication, contact, or their freedom.

The pair - aged 37 and 23 - have previously been convicted of incest, after the woman gave birth to a child in 2011.

Isn't it obvious that they are in love? Why interfere?

Consenting Adults Still Being Prosecuted in South Dakota

Yet again, we see the very real harm caused by unconstitutional laws that still criminalize sex between consenting adults. As we have seen before, there is a federal case being made because some adults have loved each other. Jane rightly exposes the absurdity of prosecuting this case.

United States Attorney Randolph J. Seiler announced that an Eagle Butte, South Dakota, man and woman have been indicted by a federal grand jury for Incest.

Counselor Seiler, I'm sure you are a valuable asset to our federal government. Why are you prosecuting consenting adults for having sex in private?

Daniel Mexican, age 43, and Santana Mexican, age 25, were indicted on December 14, 2016.  They appeared before U.S. Magistrate Judge Mark A. Moreno on December 16, 2016, and pled not guilty to the Indictment.

There is no victim! Honorable Judge Moreno, please dismiss this!!!

Will Sister Wives Go to Washington?

Ben Winslow had an update at fox12now.com on the court case of the Browns, who've been featured in "Sister Wives." They are asking the Supreme Court to get involved.

Reality TV polygamist Kody Brown and his wives are asking the U.S. Supreme Court to consider a challenge to Utah's anti-polygamy laws.

Good for them. The law in Utah is even more discriminatory than the laws in the rest of the states, unconstutionally criminalizing polyfidelity.

Brown and his four wives, Meri, Christine, Janelle and Robyn, plan to file a petition for certiorari with the nation's top court, challenging the state's ban on polygamy. The petition, filed Monday, basically focuses on whether the Browns really faced a threat of prosecution from Utah County Attorney Jeff Buhman.
Brown family attorney Jonathan Turley argued they do.

"Mr. Buhman and his colleagues appear to value the law precisely because it can be used pre-prosecution for investigations and corresponding searches, which may only last hours or days," Turley wrote. "However, plural families and cohabitating adults must live under the constant threat of being subject to a different and easier threshold for searches since their very family structure is all that is needed to justify investigations."

Someone may try to defend keeping a bad, unconstitutional law on the books by saying that it isn't enforced often, or is only enforced against people who are doing other crimes. It's not true. All it takes is a power-hungry person with prejudice to use a bad law to harass people, drag them into court, split up their family, and other discriminatory actions.

Oklahoma Still Denying the Right to Marry

Yet again we see that not only are Americans still being denied their right to marry, but they're being denied their right to be together at all. Today's example comes from a report by Scott Rains at swoknews.com...

A biological mother and daughter are wanted for felony counts of incest after investigators say they married each other earlier this year.

Who exactly did it harm that they got married? And yet they are accused felons?

According to investigators, this is the second marriage for the mother to one of her children. 

Again, who are they hurting?

Felony arrest warrants were issued in Stephens County District Court charging Patricia Ann Spann, 43, and Misty Velvet Dawn Spann, 25, each with a count of incest, court records indicate. Each woman faces up to 10 years in prison if convicted. 

Ten years in prison. For marrying. The Stephens County District Court is wasting public resources. This is infuriating. Friends of ours have been investigated, had children taken away, been charged with crimes for simply being adults in love with each other. We feel for these strangers.

The charge stems from the March 25 nuptials between the two women. In an affidavit filed in court, Duncan police Detective Dustin Smith stated that he began investigation Aug. 26 after an Oklahoma Department of Human Services Child Welfare Division investigator uncovered the information during the course of an investigation regarding children in the Spanns' Duncan house. 

Anyone can anonymously contact authorities and claim children are being neglected and abused. If an investigation reveals otherwise, great. If children are being abused or neglected, charge people with those crimes. Don't charge adults with crimes for exercising their fundamental rights. Since this news report doesn't include any allegations of child abuse or neglect, I'm assuming authorities didn't find children were being abused.

Patricia Spann indicated she is the biological mother of Misty Spann and two other males  all the product from a first marriage and that she'd lost custody of the children to their father's mother.

This sounds very familiar. The difference is that this woman apparently didn't realize there are still unconstitutional, bigoted discriminatory laws in place. Lovers still need to protect themselves.

Patricia Spann told the investigator that she didn't have contact with her biological children until about two years ago. When she reunited with Misty Spann, she found "they hit it off." 

This sounds like Genetic Sexual Attraction.

The two were married March 25 in Comanche County. She told the investigator she'd "looked into it" and, because her name was no longer listed on the birth certificate, she felt no law had been violated, according to the affidavit. 

Although it was possible to get a marriage license, unfortunately, the laws most states still have are problematic. One of the cruel things is that they probably wouldn't be treated as family if one of them ended up in the hospital.

Both women are aware of the biological relationship and have considered requesting an annulment. At no time during the questioning did Patricia Spann indicate she'd been married to her eldest son, Smith wrote.

Again, who was harmed by this? Let them all marry if they want. That's the way it'll been sooner or later. Get on the right side of history and stop wasting public resources attacking adults for loving each other.

If there is more to the story behind the paywall, I don't have access to it.

I see no good reason to deny these people their rights, throw them in jail, and break up their home.

A mother and son whose forbidden love affair could land them each a lengthy jail sentence have declared they are 'madly in love' and nothing will tear them apart.

Monica Mares, 36, and her son Caleb Peterson, 19, face up to 18 months in prison if found guilty of incest at a trial later this year in New Mexico.

Prison... for being consenting adults who love each other. It really doesn't matter how many people find this disgusting or shocking. The basic question is, should consenting adults be denied their fundamental right to be together?

What Happened at the Hull Crown Court in East Yorkshire? - UPDATED

At first, this article by Gaby Bissett at dailymail.co.uk appeared to be about yet another ridiculous, destructive prosecution of consenting adults for having sex.

A man who fathered two children with his niece after the pair started a sexual relationship has been jailed for four-and-a-half years.

"Started a sexual relationship" prompts me to ask why are we wasting resources prosecuting and imprisoning consenting adults for having relationships???

A court heard that the 'appalling and sad case' was revealed after a social services investigation.

The pair had been having a consensual sexual relationship, leading to the birth of two children.

"The pair had been having a consensual sexual relationship" prompts me to say that only thing appalling and sad is that anyone is interfering.

Speaking at Hull Crown Court, East Yorkshire, Nigel Clive, prosecuting, said: 'The situation, in short, is this - Hull social services were invited to intervene as a result of the birth of two children.'

He said DNA tests proved the link between the children and their parents, who appeared in the dock together.

Well I'd think DNA tests would prove a link between children and parents. People who make children together do tend provide their DNA, after all.

Judge Jeremy Richardson QC said: 'The reality is, they were having an intimate, consensual sexual relationship with each other.'

An "intimate, consensual sexual relationship" shouldn't be a crime.

David Godfrey, representing the niece, said she had already 'suffered' after losing her children to social services.

Why were the children taken? It appears so far in the article the only harm here is what is being done by the authorities.

Consenting Adults Imprisoned in Swaziland

Here's another case of an outrageous prosecution of consenting adults for loving each other. Starsky Mkhonta reports at observer.org.sz...

Police pounced on a brother and sister for continuously having sex, which resulted in two children being born.

The incestuous relationship between Sampi Dlamini (35) who is a soldier and his blood sister Ntombifuthi Dlamini (22) had worried residents of Mahlalini for a long time.

What's to worry about? Why not just let them be?

This newspaper established that the Dlamini siblings had even gone public with their illegal relationship. It is a crime in Swaziland to have a sexual relationship with your biological relative.

It shouldn't be.

A Hypothetical About Consanguineous Sex

The Stig Mommy asked “What Would You Do?” Here’s the situation.

You meet your DH [Dear Husband], date for years, are madly in love and get married. You have four beautiful, smart, and healthy children. Your marriage is still strong after 15 years.

15 Years into your marriage you somehow discover that your DH’s father (who has passed away) had an affair and a love child from a disclosure by your MIL [Mother-In-Law]. The name of the other woman strikes a chord with you but you cannot remember where from. Weeks later it is still bugging you so you go digging. Turns out this woman is listed as your birth mother on your adoption papers. She too has passed away before you ever got a chance to meet her. You match the timelines up and it turns out YOU are that love child. Surprised

WWYD??

Tell your husband that you are actually brother and sister? Would you get a divorce? Stay together? What would you tell the kids? Or would you keep the whole thing a secret and sweep it under the rug? Please explain your reasoning.

This sounds like Genetic Sexual Attraction. So what would you do, dear reader?

I’m a male and not gay, so if I was a husband who had discovered this truth about my wife (that we were half-siblings) I would tell her only if I thought it would make her happier or have no effect. I would not tell her something like this if it would upset her, seeing that she could not do anything about it. But I wouldn’t be married to a woman who is grossed out by the very idea of consanguineous sex, and I’m sure she wouldn’t want to be married to me. So most likely, I would tell her. Nobody else necessarily needs to know. Notice that the children in this hypothetical are healthy.

What if you had to live with it as an open secret? As in everyone know that you are brother and sister and decided to stay married.

The problem there would be bigotry. But I would challenge the gossips to explain exactly what the problem is. It would provide many teachable moments, showing that such marriages can be lasting and happy. The problem, in so many places, is that ridiculous laws that are still on the books and still enforced would invalidate the marriage and may even lead to prosecution, for the "crime" of loving each other.

Philled Up

The Dr. Phil Show is one of those shows for which there is little benefit for someone looking to present the reality of polyamourous or polygamous or consanguinamorous relationships to participate. This show is not unique in these respects, but it is our example for today.

It's Dr. Phil's show (hence the name), and Dr. Phil, unless I've missing something (which is possible, because I rarely watch or read anything by him) professes monogamy as the ideal for all and probably is also biased again consanguinamory. The show runs on commercial television, which means it is advertiser-supported. The target audience has fears and biases against ethical nonmonogamy. Dr. Phil's staff controls the microphones, the editing, and everything else. It is highly unlikely someone in an ethically non-monogamous or consanguinamorous relationship is going to be allowed to portray their relationship as anything other than some sort of terrible mess or abusive. They're going to be expected to be lectured by Dr. Phil.

Whatever one thinks of Thom Miller of Mansfield, Ohio, a self-proclaimed polygamist who has been in the news lately, there was no way any polygamist was going to be portrayed well on this show. Dillon Carr reported at richlandsource.com...

The Pain in Spain Repeated Refrain

There's been much interest around the planet about the couple in Spain who've had their infant (temporarily, hopefully) taken away. We wrote about this previously here.

Now we get into the blatant opinions. Elizabeth Licata had coverage at mommyish.com under the headline "Incestuous Father-Daughter Couple Fights for Return of Their Baby, Which They Probably Should Not Get."

The heart wants what the heart wants, and when it comes to relationships there is a fine gray line between “legal” and “awful,” but this case of a couple from Spain who are fighting the courts for the return of their new baby is nowhere near that line, because the couple are a father and his teenage daughter, and everything about this case is positively stomach-churning in its horribleness.

That's not a reason. It begs the question.
