A Polyamorous Consanguinamorous Marriage Denied Equal Rights

We are happy to be bring you another interview. As this interview is being published, there are many people still spending more time home with family members. Perhaps some of them will find this interview an inspiration? Or they can see this for some possibilities.

People in consanguinamorous and polyamorous relationships are everywhere, though many polyamorists are closeted and consanguinamorists are even more likely to be closeted. Fortunately, some are willing to be interviewed for this blog. As a result, Full Marriage Equality has featured scores of exclusive interviews with lovers denied the freedom to marry and have that marriage treated equally under the law. Most can’t even be out if the closet or they’ll gave prosecution under absurd incest laws, which, instead of focusing on abuse, also target consensual relationships.

The woman interviewed below should be free 
to legallmarry her spouses, or simply to be together as a triad or throuple without having to hide, yet they can’t. They are consenting adults who aren’t hurting anyone; why should they have been denied their rights? In much of the world, they could be criminally prosecuted for their love, and might be persecuted severely in addition.

Attention Outgoing State Governors

There are state Governors in the US who are rapidly approaching the end of their terms as Governor and will be leaving that office.

We are respectfully imploring you to use your executive powers to pardon any of your residents convicted of crimes due to having consensual (to be redundant) sex with an adult under anti-incest laws, whether they are currently in the justice system or not, even if they have since passed away,

Let's be clear. We're not talking about assault or child molestation. We're talking about sex between consenting adults (or between minors close in age to each other), still criminalized in your states. The laws should be changed, but since they haven't been yet, please have mercy on these people.

This plea is directed at the following Governors:

This plea is also directed at Governors of US territories: If you have the power to do so, pardon or at least commute the sentences of those listed as criminals due to consanguineous affections.

If you are the Governor or someone on the Governor's staff, or someone with access to the Governor, please act quickly to get this done. We know time is very limited.

There is no good reason these people should suffer any more for having had a physical relationship.

Let's stop wasting public resources on treating these people like they are a threat to anyone. If they were convicted of additional crimes relating to the investigation, their arrest, prosecution, etc., please consider pardoning them of those, too.

Do the kind, merciful, and just thing as you end your term as Governor. Get on the right side of history!

Florida Keeps Prosecuting Consenting Adults

It's not a crime to give birth to a child with health problems, but it is treated like a crime when genetic tests reveal that the child's parents are relatives who are "too" close. Here's an article from dailycommercial.com about such a case...
A Groveland woman was arrested for having an incestuous relationship with her brother after she gave birth to a child with serious medical problems.
Notice she was arrested for consensual (to be redundant) sex.
According to an arrest affidavit, Pauline Elizabeth Martin, 33, gave birth on Nov. 21, and doctors quickly transferred the baby to Winnie Palmer Hospital for Children in Orlando because it needed specialized care.
That's too bad. It's interesting that the article doesn't specify the details of the specialized care.
Hospital officials called the Florida Department of Children and Families to investigate because genetic testing revealed the baby’s parents were close relatives.
Medical privacy only goes so far.

Florida is Still Prosecuting Consenting Adults

The overwhelming majority of consanguinamorous relationships never result in an arrest or prosecution. In fact, right now, as you read this, there are people engaged in consanguinamory not too far from where you are, whether you like that or not. Unfortunately, sometimes people aren't as careful as they should be.

The latest case getting international media coverage is from the state of Florida. Much weird news comes out of Florida, but this is weird primarily in that consenting adults are being prosecuted for consensual (to be redundant) sex.

According to Panama City arrest records, a father and daughter were arrested Tuesday and charged with incest.
Police arrested Justin Bunn, 39, and Taylor Bunn, 19.
So they are consenting adults.
Police arrest records state the father and daughter were witnessed having sex in their backyard on Wakulla Avenue in Panama City.
So someone ratted them out. We don't know the condition of the backyard. Did the neighbors have to strain to see them or not? Depending on the condition of the backyard, I could see issuing them a warning or a ticket, but charging them with a serious crime is ridiculous and a waste of resources. The neighbors should have gone to them sometime later and requested they be more discreet, rather than ratting them out. Notice the charge isn't for public exposure.

Court Victory for LGBT and Polyamorous Parents

A Miami-Dade circuit judge has approved a private adoption allowing three people — a gay man and a married lesbian couple — to be listed on the birth certificate of their 23-month-old daughter.
This is a victory for LGBT parents, monogamous or polyamorous, and polyamorous parents in general.
“We’re creating entirely new concepts of families. If you have two women seeking to be listed as Parent One and Parent Two, that does not exclude listing a man as father,” said Miami family lawyer Karyn J. Begin, who represented dad Massimiliano “Massimo” Gerina in a two-year paternity case involving lesbian friends who had his baby.

While this is a defeat for this lesbian couple, it is a general victory for LGBT rights (as well as the rights of anyone seeking donated sperm or eggs), because it will allow couples who do want a third parent involved to have that involvement. But it does require that the parents agree ahead of time what the arrangement will be. Nobody should donate or accept donated eggs or sperm without a legal agreement as to whether the donor will be an active parent or just a donor.
On only a verbal agreement, Gerina gave the women his sperm and Italiano conceived. The lesbians planned for Filippazzo to later adopt the baby and they would both raise the child.
Florida law specifies that sperm donors have no legal rights in artificial inseminations. Thus the hitch: Gerina says he considered himself a parent, not simply a donor. The women, he claimed, “wanted a father for the baby, not just the sperm.”

Two weeks after insemination, Italiano learned she was pregnant. About seven months later, the women called Gerina and asked him to sign a contract.


“When they gave me the paper to sign that I had to give up all my rights to the baby, I didn’t,” he said.
Gerina began to ponder the legal consequences of siring a child. He hired Begin and presented the women with papers of his own.


“My papers said I would have parental rights, a visitation schedule,” he said. “They hated it. They said this wasn’t what they wanted. I said, ‘Now that you’re already pregnant, you should have thought about that before.’ ”
The important thing that makes this a victory for polyamorous parents, LGBT parent couples, and anyone who donates or receives egg or sperm donations is that it allows for three parents, if that is desired.

Daily Mail Picks Up Mother-Daughter Videos Story

It is no surprise to me that, what we just covered in a previous update was also picked up by dailymail.co.uk. They, of course, ran several pictures and this link to their coverage may be considered NOT SAFE FOR WORK.
A mother and daughter duo from Florida have created a porn site where they perform and film sex scenes together.

Known as The Sexxxtons, mother Jessica Sexxxton, and daughter Monica Sexxxton have been creating sexual content for their namesake website since last year and have recently released a DVD.

Kissing Cousins Are Hardly a Scandal

It appears that, like so many other times through history, someone's sex life and the incest stigma are once again being used by political opponents.

We're rapidly approaching an election here in the US (actually, early voting is underway in some places), and in addition to the Presidential race and all of the Senate and House of Representative races, there are many, many other state and local offices subject to the election. It can get overwhelming and I especially feel sorry for people here who are not allowed to vote but have to endure so much noise.

An ongoing story out of Florida caught my attention. A week ago, Chris Joseph had a blog entry at browardpalmbeach.com with the headline "Marlene Ross, Boynton Beach Commissioner, Sent Nude Pictures to Cousin, Report Says."

My initial response: So what??? If an adult sends nude pictures to another adult, why is that anyone else's business, unless we're talking about criminal harassment? In addition, it should make no difference that the recipient was her cousin.

Is Florida Prosecuting People for Consensual Sex?

Unfortunately, we are given the name of the alleged "criminal" which is probably why we're not given the age of the supposed "victim" because it would be considered identifying her.

From marconews.com comes this terse report, lacking enough information...
A 20-year-old North Naples man is accused of incest after a female relative became pregnant.
 Notice the charge is "incest," not sexual assault, not statutory rape.
Family members called deputies Tuesday after finding a positive pregnancy test in the alleged victim's sock drawer, according to an arrest report.
Family members called police. Not the supposed victim. Either the supposed victim didn't complain to them, or they only cared once she became pregnant. My guess is that she never complained to them.
She told deputies she had sex with Anthony Alan Larde, 20, about five times, a report said.
She said they "had sex." Notice she didn't say she was raped.
Larde told investigators he did have sex with the relative but added that "it was her idea," the report said.
Rapists say that, too, so that isn't relevant, other than the fact that if that is true and if this was indeed consensual, it makes it even more ridiculous that he's been arrested.
Reports did not indicate the relationship between the 20-year-old and the alleged victim, whose age was redacted.
Wouldn't the police have noted she was underage if she was? In Florida, the ange of consent is 18, but a person 23 years of age or younger can legally have sex with a complete stranger who is 16 or older. If they are of legal ages, his being arrested and her not could be yet another example of the stupid idea that young women do not enjoy sex.

So what do we likely have here? Two people enjoying sex  with each other, perhaps even lovemaking, if they are in love. Why is anyone interfering in their relationship? Why should he be prosecuted? If they want to have sex, if they want to be together, if they want to get married... they should be allowed to do all of those things. It is time for Florida authorities to get on the right side of history and stay out of out bedrooms!

John Goodman is Not Committing Incest

We're not talking about the actor, but someone else.

Goodman is a Houston native and heir to the late Harold Goodman, who founded Goodman Manufacturing, the second-biggest producer of air conditioning units in the country. He's also the founder of the Palm Beach International Polo Club and lives in neighboring Wellington, Fla.

He is facing a huge payout in a lawsuit because according to authorities, he caused a fatal accident while allegedly driving drunk. I am NOT here to defend drunk driving or vehicular homicide.

In an unusual move that seems an attempt to shield some of his trust fund wealth from a potential civil verdict, Goodman has legally adopted his current girlfriend, 42-year-old Heather Hutchins. According to CBS 12 in Florida, by naming Hutchins as his child and heir, she is immediately eligible to one-third of his estate as she is over the trust maturation age of 35. Goodman has two other children (who live in Houston) but both of them are under 35.

The judge in the case wrote that "the events border on the surreal and take the court into a legal twilight zone." Strangely, adult adoption has been used before to benefit relationship partners, particularly by gay couples who can't legally marry or pass on their wealth without significant tax barriers.

The most famous case of an adult adopting a girlfriend for estate purposes is when Olive Watson, daughter of IBM founder Thomas Watson, legally adopted her lesbian partner Patricia Spado in 1991. The couple broke up a year after the adoption, but once Thomas Watson and his wife passed away, Spado claimed that she was entitled to a share in the estate as his legal grandchild. The Maine Supreme Court declared the adoption legal in 2009, but a probate court has declared that since Watson was not aware of the adoption at the time of his death, she should not inherit, but an appeal is still pending.

So now tongues are wagging with "eeew!" and "Isn't this incest?" No, it isn't incest biologically, nor sociologically (she did not grow up as his daughter), nor legally (at least not in Florida.) He is, according to authorities, responsible for what amounts to murder, and people are concerned about whether or not adopting his adult lover is incest?!? People need some priorities. An adult should be free to HAVE SEX with ANY consenting adults (and for whatever reasons), including an adult he or she adopts.

If someone wants to reform some laws as a result of this move, they should reform the inheritance laws, not further criminalize sex between consenting adults. This negative fixation on the sex lives of others is ridiculous. Murdering someone is disgusting, not consensual sex.

Kristilyn Smith Convicted of a Crime For Consensual Sex

To update a situation I last wrote about here, an adult woman plead no contest to charge of incest for having consensual sex with her father. At least she was given five years probation instead of prison time. The charge should have been dropped anyway. There were apparently crimes in this case. Consensual sex between adults shouldn’t have been the problem.

Prosecutors agreed to drop a charge of child neglect and a second count of incest against Kristilyn Smith, 27, of Daytona Beach, bringing to an end the criminal cases against her. Circuit Judge Kim C. Hammond found Smith guilty of the remaining incest charge.

Judge Hammond, didn’t you feel silly convicting someone of a crime for having sex wth another adult?

The Flagler term of probation will run concurrent with 15 years' probation Smith received in August in Volusia County on another incest charge.

Earlier this year, her father, Alton E. Smith Jr., 48, pleaded guilty to two counts of incest, one count of living off the earnings of prostitution and 52 counts of possession of child pornography. He was sentenced to 15 years in prison, followed by 15 years' sex-offender probation and will be required to register as a sex offender.

He should have gone away for at least that long just for the child porn.

He is also barred from having contact with his daughter or wife.

Ridiculous. I can see denying him contact to his son (he had with Kristilyn) until the son is an adult and can make up his own mind, but as for contact with his wife or Kristilyn, either we have freedom of association or we don’t. Either consensual sex between adults is not a criminal matter, or it is. It is time to consistent.

Also earlier this year, Tina Marie Smith, 45, who is Alton Smith's wife and Kristilyn Smith's stepmother, pleaded guilty to aggravated child abuse and was sentenced to 10 years' sex-offender probation. She will not be listed as a sex offender.

Throw the book at people who molest children. Don’t bother trying to stop consenting adults from sex or love with each other. Let’s remove incest laws or change them so they reinforce laws against rape and child molestation, not to consensual sex.

Update on Superfluous Incest Prosecution

In an update on something I wrote about previously, we get this headline: “Woman Enters Plea in Prostitution/Incest Case.”

A former Palm Coast woman who, in a case involving prostitution and incest gave birth to her father's son, has entered a plea of no contest to a felony charge of child neglect, prosecutors said.

So why isn’t the headline “Woman Pleads No Contest to Child Neglect?” The headline an this opening line are meant to tie consensual sex between adults – “incest” – to child neglect, as if someone was molesting the child.

Kristilyn Smith, 27, will be sentenced Aug. 31 in Volusia County circuit court for the second-degree felony. The no-contest plea is part of an agreement that will also resolve her criminal charges in Flagler County but prosecutors declined to provide any other information. She could be sentenced to anything from probation to 15 years in prison.

Her father, Alton E. Smith Jr., is serving a 15-year sentence and remains held at the Reception and Medical Center in Lake Butler.

Both the father and his wife, Tina Marie Smith, had been facing child pornography charges. He had a photography business, through which he took pictures of models of all ages.

Kristilyn Smith, who now lives in Daytona Beach, was charged with two counts of incest and one count of prostitution and one count of child neglect in Flagler County.

Child neglect is the real crime. The neglect seems to be from the father and daughter having sex in front of the child. Prosecutors should have gone ahead with the child porn charges against the father and his wife and dropped all “incest” charges. Exploiting children is certainly of more concern than consenting adults having sex, isn’t it?

Superfluous Prosecution of Consensual Sex

Here is an example of using unjust laws against consanguineous sex to superfluously punish someone. If someone like this Palm Coast, Florida man, Alton E. Smith, abuses children, then he should have the book thrown at him for doing so. He should get at least fifteen years in prison for abusing children. But why prosecute him for sex with a consenting adult? If the laws can be used against him, they can be used against anyone. The charges stem from his relationship with his adult daughter.

Alton E. Smith, 47, pleaded guilty to two counts of incest, one count of living off the earnings of prostitution and 52 counts of possession of child pornography. In addition to the 15-year prison sentence, Smith is expected to be placed on 15 years sex offender probation and be required to register as a sex offender, according to the plea agreement. He is also barred from having contact with his daughter or wife.

Unless he abused his wife and daughter and they requested protection, how can they justify barring contact?

Smith's plea brings closer to conclusion the sordid situation revealed by a Flagler County Sheriff's Office prostitution sting on Carlos Court in Palm Coast in December 2008.

Isn’t it time to decriminalize prostitution? Sure, go after abusive pimps for assault, threats, whatever, but consenting exchanges between adults are nobody else’s business.

Today's sentencing will leave only Alton Smith's daughter's case unresolved. His daughter is charged with three counts of incest, child neglect and prostitution.

If she neglected her child, then fine - she should be punished. But the incest and prostitution charges are ridiculous.
