West Virginia Arrests Consenting Adults

News continues to comes out of Nicholas County, West Virgina, where two consenting adults were arrested for having consensual sex with each other. Life must be nice there if law enforcement personnel have time to care about "crimes" like this. Here's an early report by Travis Brinks at wvmetronews.com...

Two Nicholas County residents are in jail charged with incest.
Deputies in Nicholas County arrested Kelcey Nicholas, 28, and Lataura Jarrett, 21, both of Mt. Nebo Friday. 

While deputies were arresting Nicholas on a warrant for home confinement violation at his home in Mt. Nebo, they noticed inappropriate conduct between Nicholas and Jarrett, his step daughter.

Inappropriate to whom? They are consenting adults in a private residence. But notice, this was a matter of voluntarily revealing too much to law enforcement.

After further investigation, deputies learned that Nicholas had been married to Jarrett’s mother for the past five years and was still married to her.

Why was there even a need to investigate? Sounds like they are trying to bust this guy any way they can.

Both Nicholas and Jarrett admitted to having sex with each other at least seven times since July 15. 

Both were taken into custody and currently sit in the Central Regional Jail on $35,000 bond.

Since both were arrested, who is the victim? Was there any complaint on the par of Jarrett's mother? This guy is seven years older than Jarrett. He married her mother five years ago, which would have made Jarrett 16. How long was this guy around before then? He didn't raise her. They are consenting adults. What is the problem?

I have also been in an incestuous relationship with my younger sister. ( only three years) and I also don't feel it is wrong enough to be criminalized, but her family has drove us apart ( half siblings). As always, I advise caution, even if you are out or want to come out. Television is usually about drama for the sake of selling advertising; those in control of what airs may not have the priority of depicting polyamory or involved individuals fairly or accurately.

His Mother Fell For Two Brothers

Someone named Thomas had a question/complaint at a certain Big Internet Portal's question-and-answer service. I would have answered his question directly, but the flaws of how the system there is set up allowed (what was probably) one person who simply didn't like my opinions to get me banned from participating. Anyway, here's what Thomas wrote...

Why did my mom get pregnant to two brothers?

My guess? Because she had sex with them without using contraception effectively. I know, I know, that's not really what he's asking...

She had me with my dad. Then slept with my dads brother and got pregnant to him 2 years after I was born, and had my sister. She wasn't married to either. They were just casual things. But could she not have picked guys who weren't related? It causes so many problems within our family because she has sex with them (seperately) sometimes. Its embarrassing when people work out that my sister and I are cousins as well as siblings. Even though its not incest they act like it is. Why is she such a ho with no consideration for her son and daughter? What makes it worse is that I see my uncle as more of a dad to me than my actual father and I wish he was. Its a messed up situation all round. All because of her.

Why would it be better to be "half-siblings and nothing" as opposed to "half-siblings and cousins?" Unless the two men were having sex with each other, there's nothing incestuous about any of this. It is not incestuous for a woman to have sex with one person and then have sex with a close relative of the first person. That other people give Thomas grief (especially about something over which he had no control) indicates they are prejudiced jerks, but it is just another example of the absurdity of the irrational "othering" of anything that some people might so much as mistake for involving consanguineous sexuality.

I would have pointed Thomas to historical traditions and to the fact that in ancient books like the Bible, some people were commanded to have sex with (and marry and have children with) the sibling of their prior spouse. Even today, continuing what can be found in the Bible and other old writings, polygynists (including a family in the media) as well as polyandrists marry and have sex with siblings. This has gone all for all of human history.

Someone being a jerk about this should be asked, "So what's wrong with that?" They might think it is strange, but so what? Would it be better that the two men she had children with be complete strangers? Why?

This is sad.

As I've said before, Genetic Sexual Attraction almost always involves pain, even under the best of circumstances. If for no other reason, the prejudice that still exists towards people experiencing GSA is painful.

It doesn't help that in so many places, there are laws criminalizing consensual sex between adults brought together through GSA. An arrest and certainly a conviction can ruin you live. Such laws are truly unjust and should be stricken from the books.

Here is the first video, which seeks to clear up some assumptions and misconceptions, including that there's something wrong with consensual, GSA-initiated relationships or the people in them, or that one person is preying on another in such relationships. The video is also a call for acceptance and love.

Did You Watch the TLC Special?

The possible pilot for a new series featuring the Williams, a polygnous family, aired on TLC last night here in the US. Did you watch? Do you have any comments? Scott D. Pierce had an article ahead of time at sltrib.com...

"It’s not an easy lifestyle to live," said Robyn Williams, Wife No. 2 to Brady.

Brady, Robyn, Wife No. 1 Paulie, Wife No. 3 Rosemary, Wife No. 4 Nonie, Wife No. 5 Rhonda and their children are the stars of "My Five Wives," an hourlong special that’s also the pilot for a potential series on cable channel TLC.

 It’s no surprise that the story of the Williamses, who live in central Utah, is reminiscent of "Sister Wives," TLC’s series about Kody Brown and his four wives. Like the Browns, the Williamses are hoping that putting themselves on TV will make the public more accepting of polygamy.

I hope so, too. I also hope other forms of polygamy and polyamory will be included in television shows.

"Sure, it’s scary," Brady said. "But it’s important to stand up for what’s right. And it’s right to allow consenting adults who are well-adjusted and not coerced to be able to share their lives and raise their children in a stable and loving environment."

Exactly!

The Williamses have never hidden the fact that they’re polygamists. Their employers and business associates know. Their kids’ friends and teachers know.

Good.

I'm not fond of the term "reality show" because it is nearly impossible to fully depict reality on a television show. But if shows like this open minds, then I'm happy for that.

TLC to Showcase Another Polygynous Family

TONIGHT IS THE NIGHT. I'm happy TLC is doing this, and I hope they feature other forms of polygamy and polyamory in the future. In the minds of a lot of people, if it isn't monogamy, it's polygyny, but that's not reality. Scott D. Pierce reports at sltrib.com...

"My Five Wives," featuring Brady Williams, his wives Paulie, Robyn, Rosemary, Nonie, Rhonda and their 24 children, debuts Sunday, Sept. 15, on TLC. It's essentially a pilot for a possible series.

I hope it is good, giving another positive look at ethical nonmonogamy, and that it catches on with viewers.

The Williams are described as a "big, loving, progressive polygamous family ... who all live together on their large family property outside Salt Lake City."

These aren't your average polygamists, however. Brady is an ex-Mormon, but this group isn't particularly religious, we're led to believe.

"Believing in equality for everyone and a God who loves and accepts all, the Williams family emphasize that their choice to be together is more about their mutual love and commitment than it is about religion," according to TLC. "Though their beliefs and their decision to leave their church have led them to be shunned by their community and estranged from many family members, the Williams believe their sacrifices are worth it."

Do they really support full marriage equality? That would be sweet.

If you read the story, these are not fleeting made-for-TV relationships, but ones that have endured many years. There's no good reason why they shouldn't be free to be together and to marry.

This blog is about rights for consenting adults and makes a clear distinction between consensual sex and assault/abuse. When it comes to activity between minors, or people under the age of consent, the difference isn't as easy to distinguish, especially when dealing with younger children. In the US, the age of consent to sex varies from state to state. In some states, the age is 18. In others it is 17 or 16, some states with limitations about how much older the other person can be. How this works legally is that in a state where 18 is the absolute age of consent for sex, a 17-year-old is not able to legally consent to sex with, say, a 20-year-old no matter how intelligent, emotionally mature, and how attracted the 17-year-old is.



Most family therapists do no consider uncoerced, mutual sexual exploration between minors close in age to abusive. The problem comes when one minor does something with another minor who is significantly younger. So even though an 13-year-old may not be able to legally consent to sex with a 17-year-old, a 13-year-old can be held criminally guilty for doing something with an 8-year-old or a younger child.

I bring all of this up because of something I found at courthousenews.com, which asked, "Should Child Offenders Be Punished For Life?" By child offenders, the writer means "children who offend," not "those who offend against children." Sam Reynolds reported...

No Amount of Lipstick Will Help

I found a discussion thread at lipstickalley.com that got very ugly. It started when a user named sierra posted, disapprovingly, what appears to be someone else's account of experiencing Genetic Sexual Attraction...

I met and fell in love with this older man. Im 28 and he is 44. We were seeing each other for 3 years when I decided to introduce him to the family. We had a birthday party for a family member that I brought him to, it was more like a "reunion." Anyway as SOOOOON as we walked in my aunt screamed, "Oh My God, what is HE doing here? How did she find him?" Looked like she had seen a ghost. Im looking confused, my boyfriend is looking confused and then he says, "Hi Neicy, what's wrong with you, what do you mean how did she find me?" My aunt pulled him to the side, by now my mother has come over and she starts crying. Im SO confused, my boyfriend is SO confused and looks dazed. He and my aunt talk while my mother takes me in to the restroom and reveals that he is my dad. That they had gotten together one night after a game and that she became pregnant and never told him (she even transferred schools because she went to another state to live with my great aunt during the pregnancy).

After I nearly had a mental breakdown, I walked out the bathroom to find "dad" and he was gone. I tried to contact him to no avail for 3 months, I was confused but IN LOVE, we had 3 yrs together. After about 8 months he came to my house. He told me he had been receiving counseling but could not overcome his love for me as his girlfriend. Since we had no DNA to prove paternity, we got back together. My cousin "Q" continues to ask me, "Why do you want this man?" I get what he's saying but I DIDN'T KNOW...WE DIDN'T know. We did not, could not believe this was true so we decided to take a DNA test in July. I had the results sent to my sister "C" and it has showed 99.8% accuracy. We were devastated. But now we have had 3 yrs and an additional 9 months together (after the separation).

We practiced restraint since July and decided to try to have a dinner together a 2 days ago to discuss how we would move forward as father/daughter, but we slipped up and our passion took over. We dont FEEL like father/daughter. After the encounter, we even discussed moving to another state to be together, but it's not practical. I know we are wrong but HOW DO WE MOVE ON? We will always be in love. This is breaking our hearts and driving us crazy. Is it THAT bad to sleep with dad (since we didnt know)? HELP ME

I don't know where sierra got this account, but if this a real story, and I do believe it is possible and it appears to be credible rather than outlandish, then this sounds like Genetic Sexual Attraction.

The responses were the kind that sting people who have experienced GSA. They are highly phobic and prejudiced. Continue on and your own risk.

Will not supporting incest make an LGBT supporter hypocritical ? If you look at it, he or she is arguing for sexual freedom for two consenting adults. Now if they happen to be blood related and this makes them lose the support of the the said person, will he or she be hypocritical?

If we're going to take the rights of consenting adults seriously, consanguineous lovers can't be excluded.

On a totally theoretical level, I have no problem with two consenting, fully aware, informed adults having a relationship just because they share a certain percentage of genetic material.

Good.

However, we have to remember that a lot of incest (though certainly not all) is a product of abuse and happens in abusive contexts.

Well, yes, the world "incest" is applied to the two very different things of consensual sex and assault/abuse, but the person asking was talking about consensual sex. Do we ever say "We have to remember that a lot of intercourse is a product of abuse and happens in abusive contexts?" Do we comment on BDSM by saying a lot of handcuffing has been the product of tyranny or slavery? See Discredited Argument #9.

So….yeah. I mean, we need to be aware and supportive for victims of incestual rape, but I don’t think that incest in pure theory is inherently bad.

I'll take the support for sexual and relationship rights. A woman should be free to marry a woman, or two women, even if one is her sister. That's feminism.

Tumblr is full of fetish porn, which I'm not in any way knocking. I bring that up because it is great to see serious consideration of consanguinamory as part of the mix there.

Do the Kardashians Need to Come Out as Consanguinamorous?

[I am bumping up this old entry because it has been getting hits lately and it still relevant. I will add a note at the end, too.]

It's happened before, and it's happening again... questions about possible consanguinamory in the Kardashian clan. This time, Linda Stasi protests too much at nypost.com.

On Sunday night, Khloe Kardashian Odom stooped even lower than Kim could go by hitting on her own brother, Rob.

Stasi is unaware that this actually happens between siblings who are not on TV shows, and most if it is done without "stooping."

Anyway, Khloe, the Chewbacca of the Kardashians, proved herself to be even more of a repulsive lowlife than her fame-whore sister, Kim.

I see: flirting bad, calling people a wookie, repulsive, lowlife, whore... good?

We’re talking about implied incest for ratings! What next? Reality-show murder?

There's already plenty of murdering on TV. Why not depict flirting and affection between siblings, which, again, does happen in life? Affection is preferable to murder, right?

I confess I only watched this garbage after being urged to do so by a guy who watched with his family and was stunned and disgusted by what took place.

Riiiight, Linda. Are you going to watch some late night Cinemax next to see if responsible condom use is depicted?

On the episode, Khloe’s brother Rob the deadbeat (which, in that family, means you don’t have as many endorsements as the rest of them), supposedly moves in with her and her husband, Lamar Odom.

Jealous much?

Khloe tells Rob to promise he’ll never give her attitude again, to which he replies after a bit more idiotic banter, “If I do, I will reduce the size of my penis.” What? I can’t wait to speak like that with my brother.

Chewy then coos, “You don’t have a penis, you have a [bleep],” while draping herself over him adding, “Lamar thinks I’m like Cleopatra, and I’m gonna marry my brother.”

When Rob tells her that’s not going to happen, she says (warning: turn away if you have a weak stomach),“You won’t [bleep] me?"

Sounds like teasing to me. Siblings never ever tease each other, of course.

State of New York Still Prosecuting Consenting Adults

That's the impression given to me based on what I can read of this article by Mike Hibbard at fltimes.com. The article is partially hidden behind a pay wall, so I can only base this on what I could see for free.

A Benton man accused of having sex with his sister is looking at a possible prison sentence.

Marvin Martin, 28, pleaded guilty Tuesday in Yates County Court to third-degree incest. The charge is a class E felony punishable by up to four years in prison.

That charge is for consensual sex. And notice the article says "having sex," which I consider entirely different than assaulting. "Having sex" implies mutual consent. This is what the law say in New York...

§ 255.25 Incest in the third degree. A person is guilty of incest in the third degree when he or she marries or engages in sexual intercourse, oral sexual conduct or anal sexual conduct with a person whom he or she knows to be related to him or her, whether through marriage or not, as an ancestor, descendant, brother or sister of either the whole or the half blood, uncle, aunt, nephew or niece. Incest in the third degree is a class E felony.

In New Jersey, this wouldn't be happening.

If this had been assault or molestation, he could have been charged with 1st or 2nd degree incest, which deal with assault.

If this was consensual, it shouldn't be a crime.

If this was assault, did the DA make a deal in exchange for the guilty plea? Someone who rapes someone else should face a lot more than four years in prison. Someone who has consensual sex with another adult shouldn't be arrested in the first place.

Here are the laws against assault of a family member...

§ 255.26 Incest in the second degree. A person is guilty of incest in the second degree when he or she commits the crime of rape in the second degree, as defined in section 130.30 of this part, or criminal sexual act in the second degree, as defined in section 130.45 of this part, against a person whom he or she knows to be related to him or her, whether through marriage or not, as an ancestor, descendant, brother or sister of either the whole or the half blood, uncle, aunt, nephew or niece. Incest in the second degree is a class D felony.

§ 255.27 Incest in the first degree. A person is guilty of incest in the first degree when he or she commits the crime of rape in the first degree, as defined in subdivision three or four of section 130.35 of this part, or criminal sexual act in the first degree, as defined in subdivision three or four of section 130.50 of this part, against a person whom he or she knows to be related to him or her, whether through marriage or not, as an ancestor, descendant, brother or sister of either the whole or half blood, uncle, aunt, nephew or niece. Incest in the first degree is a class B felony.

A kind person responded to my email inquiry about this, telling me this was a plea deal. From the full article...

Martin pleaded guilty under an Alford plea, where a criminal defendant doesn’t admit an act but admits the prosecution could prove the charge. He was arrested earlier this year by state police, who allege Martin had sex with his sister dating back to 2006, when she was 15.

The arrest was not reported to the media. With the ages of 21 and 15, this was either rape or statutory rape. It this was a rape, the sentence limitations mean the sentence will be far too lenient. There are still unanswered questions, such as why it took until 2013 to arrest someone for something that happened in 2006. Was she so traumatized that she didn't come forward until this year? Or was this something law enforcement took up because of someone else's concerns? The laws need to be reformed. Remove separate laws against "incest," instead adding sentencing enhancements for rape/assault or molestation if it is by a guardian or someone with authority or power over the victim.

Marriage of GSA Couple Annulled

Meredith Hoster reports at highlightpress.com that a marriage has been annulled and there is a new call for changes in adoption regulations in the UK.

In an incredibly rare twist of fate, a married couple in the UK have had their marriage annulled after discovering that they were in fact twins separated at birth. The pair apparently had no idea they were related, though felt an “inevitable attraction” that brought them together.

That's called Genetic Sexual Attraction, and even when people are aware of their genetic relation and GSA, it can still happen.

According to a peer addressing the House of Lords, the case highlights the importance of ensuring all adopted children have access to the details of their biological parents.

The twins at the center of the case have chosen to keep their identities hidden.

There's still much prejudice.

Speaking with the BBC in the UK, the peer spoke of the dangers associated with hiding a person’s identity over the long term. 

“If you start trying to conceal someone’s identity, sooner or later the truth will out,” the peer told the BBC.

“And if you don’t know you are biologically related to someone, you may become attracted to them and tragedies like this may occur.”

No additional details have been made public about the couple’s future intent, though to continue the relationship even at such a stage would be in violation of UK law.

There are so many questions left unanswered by this report.

Did they have children, and how are those children? Most children born into such situations are healthy, despite myths. My guess is that if there had been children, that would have been mentioned.

Did this couple WANT their marriage annulled? I understand that the law makes it happen, stupidly, regardless of what they want. So for all we know they are still together and did not want their marriage annulled.

It is ridiculous to criminalize consensual relationships between adults, and to deny them the freedom to marry.

Imagine finding someone who makes you so happy and you marry, only to have it all taken away from you. And for what? There's no good reason. An adult, regardless of gender, sexual orientation, race, or religion, should be free to share love, sex, residence, and marriage with ANY and ALL consenting adults, without fear of prosecution, bullying, or discrimination.

Two Entertainment Notes: Moebius and The House of Yes

From globalpost.com comes this note that "Moebius" went to Venice.

South Korean director Kim Ki-duk, who won the Golden Lion award at Venice film festival last year, is back in the floating city with a tale of incest and self-mutilation.

"Moebius", a story about a father's infidelity sparking a chain of violent events which lead to his wife dismembering their son, was initially banned in Kim's home country.

The Korean Media Rating Board put its foot down over the sex, nudity and incest and Kim had to cut out the offending passages before they would allow it to screen.

Does Polyandry Increase Offspring Health?

A joint study by researchers from four universities has suggested women could improve quality of their offspring by mating with multiple partners.

Experts examined the behaviour of an ancestor of the domestic chicken and found that mating with different males helped females produce offspring that are more resistant to disease, Daily Mail reported.

Now they claim their findings could be applied to other animals as well as humans.

I'm always cautious about citing the behavior of other species to support/oppose human behavior, but less cautious about comparing biological results.

In humans, polyandrous families (and polyamorous families in general) have found that having more adults around to assist, supervise, and protect children can always be helpful.

Leontiades Lauds Love, Seeks Solidarity

Louisa Leontiades covers something at huffingtonpost.co.uk that is unavoidable in ethical nonmonogamy circles, and more specifically, in polyamorous circles: differences in relationship structures and guidelines, and how that divides some. Leontiades is founder of MultipleMatch.com, where this piece was previously published.

Those who feel the inclination to love many, have to learn by doing, and are often shunned and shamed whilst doing so, making the pursuit of their relationships a thousand times harder. Indeed the fact that the polyamorous community is growing at all in the face of constant opposition, is a true testament to the power of love... and marginalization. The power that the world gives polyamorists by vilification turns it into a cause, spawning Poly-pride, support groups like PolyLiving  and not for profit organizations like Loving More. 

Polyamory has definitely been coming out of the closet, but with that come some issues.

I just want to say that my sister and I have been having regular sex for about 10 years now. We don't see anything wrong with it. If two people are attracted and in love then it should not matter if they are related.

I couldn’t agree more, other than making it clear that it doesn’t have to be limited to two.

There is so much ignorance and blatantly false information out there regarding this subject. I believe that the 'danger' is nowhere near as bad as many people claim. I personally have chatted with some people who have done this, and they reported no problems. Love between people and the birth of a child are things to be celebrated, even when it's between consenting relatives.
