Attention Outgoing State Governors

There are state Governors in the US who are rapidly approaching the end of their terms as Governor and will be leaving that office.

We are respectfully imploring you to use your executive powers to pardon any of your residents convicted of crimes due to having consensual (to be redundant) sex with an adult under anti-incest laws, whether they are currently in the justice system or not, even if they have since passed away,

Let's be clear. We're not talking about assault or child molestation. We're talking about sex between consenting adults (or between minors close in age to each other), still criminalized in your states. The laws should be changed, but since they haven't been yet, please have mercy on these people.

This plea is directed at the following Governors:

Mark Dayton - Minnesota
Brian Sandoval - Nevada
Susana Martinez - New Mexico
John Kasich - Ohio
Mary Fallin - Oklahoma

If we've missed an outgoing Governor, we apologize.


This plea is also directed at Governors of US territories: If you have the power to do so, pardon or at least commute the sentences of those listed as criminals due to consanguineous affections.

If you are the Governor or someone on the Governor's staff, or someone with access to the Governor, please act quickly to get this done. We know time is very limited.

There is no good reason these people should suffer any more for having had a physical relationship.

Let's stop wasting public resources on treating these people like they are a threat to anyone. If they were convicted of additional crimes relating to the investigation, their arrest, prosecution, etc., please consider pardoning them of those, too.

Do the kind, merciful, and just thing as you end your term as Governor. Get on the right side of history!

A Note From a Therapist

This was a comment left on the blog I wanted to highlight.

Did the Devil Go Down to Georgia?


Another day, another incomplete report of an "incest" criminal charge. (See another one here.) This one comes from the state of Mississippi. Therese Apel and Sarah Fowler report at clarionledger.com about a Georgia man. Despite two reporters being involved, they still apparently didn't get enough information from law enforcement. Again, his name and picture are prominently featured even though it isn't clear whether he was involved in a very serious crime (assault) or being charged in a victimless "crime."
A Fayetteville, Georgia man has been charged by Mississippi authorities with "adultery and fornication between certain persons forbidden to intermarry."
According to a release from Starkville Police Department, Dan Dewayne Newcomb, 69, was arrested on Tuesday on that charge, which state statute 97-29-5 classifies as "persons being within the degrees within which marriages are prohibited by law to be incestuous and void, or persons who are prohibited from marrying by reason of blood and between whom marriage is declared to be unlawful and void."
Dear Mississippi: People don't need to be married to each other to have sex.
Starkville detective Stephanie Perkins said the incident, which allegedly occurred in 2013 and was just reported, is still under investigation. She said there could be more charges in the future.
If this was an assault, charge him with that. If this was a consensual romp, leave him alone. If this was cheating, that's not a good thing but shouldn't be criminal.

Newcomb is in the Oktibbeha County Jail where he is awaiting an initial court appearance in municipal court.

The charge can carry up to 10 years in prison.

Ten years is not enough if it was assault. He shouldn't even be in jail of this was sex.

A complaint filed by a person listed as a family member alleges the incident occurred on Aug. 10, 2013, at 982 Highway 12.
That's a hotel.

Lest you think it has to be assault because it must of been the other person who went to police, that isn't necessarily true. There have been many cases of others, including family members, ratting out consenting adults for being lovers.

So, we still have no idea if this was allegedly sex between adults or an assault. I would think the initial charge would be assault if that was the allegation, but we can't be sure.

It's Refreshing to See Reason Rather Than Hate

Recently, we saw that the US state of Georgia is still arresting and prosecuting consenting adults for having sex with each other. News of this case has been distributed far and wide, often with hateful and ignorant comments. But Rachel Burger had a better take at thoughtsonliberty.com...


This is just nuts.

Collectively, the two siblings now have an arrest record and will have over $20,000 worth of debt to the state. They may have to register as sex offenders. Even though I, like many Game of Thrones fans, think that incest is unnatural and unhealthy for any future offspring they might have, I don’t think having consensual sex with your brother or sister should mean that the state has license to effectively ruin your life.

Georgia Still Prosecuting Consenting Adults

Most siblings who enjoy consanguinamory are never arrested or prosecuted for doing so, because they are never "caught" or outed to hostile or power-hungry strangers. I look forward to the day that they don't have to hide who they are or who they love. However, as long as most US states still have absurd laws against such consensual sex, it is a good idea for people to protect themselves.

There is news out of the US state of Georgia that siblings were arrested for having sex with each other. Their names and pictures are being published in several news outlets. Here's the report from G.G. Rigsby at savannahnow.com...
A brother and sister were arrested this morning in Effingham County and accused of having sex with each other in a tractor trailer parked at a church.

Christopher Buckner, 20, of Guyton, and her brother, Timothy Savoy, 25, of Jackson, Ga., were arrested and charged with incest, aggravated sodomy and prowling, according to Sheriff’s Office spokesman David Ehsanipoor.
Out of those three, only "prowling" should be a crime.
The spokesman said deputies answered a call at about 4:30 a.m. about a prowler in the area of Hester Road and Ga. 30.

As deputies were checking the area, they saw a man and woman walking down the road. The male said he was walking the female back to her house.

Deputies determined that the pair were brother and sister and that they had just had sex in a Kenworth tractor trailer, which was parked at Countryside Baptist Church, Ehsanipoor said.

He said they admitted having sex three times after watching the movie, “The Notebook.”
I wonder if the deputies would have been able to "determine" that they'd just had sex without the admission? Folks, it is risky to have sex on someone else's property if you don't think they'd approve. And, in America, we have the right to remain silent. USE THAT RIGHT. Never admit to committing a victimless "crime" even if it seems obvious that you did.
They were being held in the Effingham County jail.
Really? What kind of threat are they to anyone? How absurd.

A comment after the story asked the tired old question...
if a child was conceived will it be their son or daughter and niece or nephew?
What really matters is if a child is being raised by loving adults. To answer the question though, some children are raised in such situations and know their mother and father as such. Some children are raised by their mother or father unaware that their uncle or aunt is their father or mother.

Do we not have more important issues for police to address than this.. Yes- it's wrong, stupid and certainly not within any sort of civilized behavior.. but jail? Nah-

It was clarified elsewhere that they are half-siblings. I wonder if this is a Genetic Sexual Attraction situation? See, for example, this report at wsav.com...


The Effingham County Sheriff's Office says 20-year-old Christopher Buckner of Guyton and her half-brother, 25-year-old Timothy Savoy of Jackson have been arrested and charged with incest after they admitted to having sex.
This really shouldn't have been a criminal matter for the newspapers. The real news here is that adults are being charged with a crime for having consensual sex. The police should have told them not to fool around on church property and let them go. What a waste of resources.

So Many Questions About Georgia Case Against Father

There's a lot of helpful information missing from this article at moultrieobserver.com by Alan Mauldin, though Mr. Mauldin is probably limited by what law enforcement will release.
A man thought to have fathered up to eight children with his daughter faces incest charges in Colquitt County and could face charges in other jurisdictions in Alabama and Georgia.
Notice the article says "incest charges," not assault, rape, etc. So far, the article doesn't mention her age, which matters.

Case in Georgia Highlights Arbitrary Restrictions

The age of consent in the US state of Georgia is 16. A girl who is 16 can legally consent to group sex with complete strangers, or sex with a 50-year-old man who has been her next-door-neighbor all of her life, or a 30-year-old cage fighting champion. The State of Georgia Still Arresting Consenting Adults

Gwinnett County Police arrested an uncle and nephew on incest charges early Friday at a business in an unincorporated area between Norcross and Peachtree Corners.

Around 3 a.m. Aug. 17, a security guard called authorities to report that two people had entered a semi-trailer behind a business on the 6400 block of Atlantic Boulevard near Jimmy Carter Boulevard.

According to the police report, officers made demands for the people to exit the trailer, and they did so without incident. Police immediately arrested the two for loitering and prowling since they "had no reason to be at the closed business."

If they owned the trailer and were inside the trailer what was the problem, really?
Police noted that at first, the two people appeared to be a woman in her early 20s and a middle-aged man. After further investigation and questioning, it turned out the woman was actually a 21-year-old male from Gainesville. He had been taking hormones since he was 19 that caused him to grow breasts and develop feminine features.
So the younger person is a transgender female. If she identifies as such, the police and journalists should refer to her as female, not in male terms.
The two also told police that they were uncle and nephew, and they had been involved sexually for about two years. The nephew told their family that he was gay, said the uncle, who's a 37-year-old Snellville resident. When his nephew started gaining female features, the uncle asked him about becoming sexually involved together.
Why is this relevant to the police? They are consenting adults.

Police asked if they performed any sexual acts in the trailer, and the uncle said they only cuddled and kissed. The nephew, however, told the officer that he performed oral sex, but it was consensual and not forced.
Note: It is OK to lie to counter unjust laws.
The two were arrested on charges of incest and loitering and prowling. They were admitted into the Gwinnett County jail and remained there as of early Tuesday morning, according to the Gwinnett Docket Book.
Why is incest a crime in this instance? They are consenting adults. The article didn't make it clear if they are biologically related or related by marriage, but it doesn't matter. "Loitering" is really a charge used to punish people for having sex or looking for sex in publicly shared places (like public restrooms) often because of prejudice against their sexuality makes it risky to be seen together at home, but they went inside the trailer. "Prowling" is a charge meant to be applied to burglars. They didn't steal anything. This looks like it just harassment of consenting adults for no good reason. If they actually didn't own the trailer, there should be nothing more than a trespassing charge.

I am just stunned and shocked ...this is going to be devestating to that family...So happy they are busted...he's probably been molesting him since he was a small boy...so so sad
