Prison For Consensual Sex in Samoa


Out of Samoa comes news of a criminal case over consensual incest between a woman and her father. I don’t know if this is the same case I covered here. In this report, we find out that this could be a case of Genetic Sexual Attraction and that the daughter is married. I don’t condone cheating (her husband turned them in), but it is ridiculous to prosecute people for engaging in consensual sex. Notice that the charge wasn't adultery, it was for incest.

A 36 year old married woman and her biological father have been charged for seven counts of incest. The woman pleaded guilty but her father denied the charges. The daughter has been sentenced to three years in prison.

Three years for consensual sex!

According to the defendant's background she is the only child and was raised by her grandparents. In the probation report, the defendant did not know who her biological parents were until recently and was raised by her uncles and aunties. The defendant's parents had divorced long before and her father had moved to Australia.

In 2009, her uncle took her to meet her biological father. Her father then traveled to Samoa to come to her daughter’s birthday. He wanted to meet his daughter and build a house for her and her family.

On the night of her birthday she had sex with her 61 year old biological father at her house. It was evident that he was staying at her house as they also had sex the nights after. The father returned to Australia but came back on a number of occasions. The parties continued their sexual relationship in 2010 and 2011 until the defendant was caught by her husband and was reported to police.

He’s likely the real victim here, provided he hadn’t already shirked his responsibilities to the relationship.

The decision was based on these mitigating factors, the expression of remorse of the defendant in her statement to police and in the court. She is a first time offender. She had made attempts to heal the rifts between her family and had happened and her willingness to take part as a prosecution witness for her father's pending case and as a result of the offence she had been banished from her village.

A very sad thing. Why is someone’s sex life anyone else’s business?
