South Dakota Prosecuting Consenting Adults For Sex

Perhaps this news report out of South Dakota that lacks sufficient information is about the same case cited earlier in another report that lacked sufficient information.

The headline reports that a woman was arraigned on incest charges.

A 31-year-old Rapid City woman accused of having consensual sex with someone closely enough related to make their marriage illegal in South Dakota pleaded not guilty to incest Monday.
In South Dakota, that could mean that the other person was her first cousin. She could go to prison for having consensual sex with her first cousin. Yet in many states, they have the freedom to marry.

The woman's co-defendant, a 34-year-old man, remains in the Pennington County Jail.

Since nobody else is mentioned, we’re to assume a 31-year-old woman had consensual sex with a 34-year-old man. There’s no victim. Why is this a crime? There isn’t even a problem cited by anyone in the article. Why try to prosecute adults for having sex?

The police and the District Attorney should be ashamed of themselves for pursuing this. The judge should throw this out of court.

  1. i disagree...random, thoughtless sex seems to be the main problem with humanity as far as i'm observing... there are billions of people on the planet...why should children of siblings legally be allowed to have any type of relationship sexually? it should be illegal in not only every state, it should be illegal under this sun to subject a new innocent baby into this world from such incestuous conditions...the birth defects alone are outright obvious from egytian times. even if theres no possibility of a baby it is not right, as far as i'm concerned, in any way to have a union between such close blood relatives. it is not right in any degree or age... we are supposed to be human beings, males, females, the most superior of species, why would we want the damaged genes that result from such unions to lurk like monsters in the ever expanding human DNA pool that our researchers are mapping out right now even as we continue to try to deny that the things people do wrong sexually basically affects the whole ripple of humanity on this planet?

    1. Most children born to cousins are healthy. Furthermore, there doesn't seem to be a problem in US states and other countries where it is legal to have sex and children with closer relatives. If you don't like it, then don't do it.
